{"id":3130,"date":"2010-07-06T07:09:34","date_gmt":"2010-07-06T13:09:34","guid":{"rendered":"http:\/\/michaelsiegel.net\/?p=3130"},"modified":"2010-07-06T07:48:32","modified_gmt":"2010-07-06T13:48:32","slug":"second-amendment-linkorama","status":"publish","type":"post","link":"https:\/\/michaelsiegel.net\/?p=3130","title":{"rendered":"Second Amendment Linkorama"},"content":{"rendered":"<p>This week so the Supreme Court deliver a stunning victory for Second Amendment liberty by extending the <i>Heller<\/i> doctrine &#8212; that the Amendment protects an individual right to bear arms &#8212; to the states.  This has been a long time coming.  But it&#8217;s gotten to the point where even gun control advocates can longer defend the <i>Miller<\/i> philosophy that the Second Amendment protects &#8220;militias&#8221;.  Even Elena Kagan is acknowledging <i>Heller<\/i>.  It may be some time before the Second amendment is seriously threatened again (although the liberal wing still <a href=\"http:\/\/www.washingtontimes.com\/news\/2010\/jun\/29\/sotomayor-targets-guns-now\/\/?page=1\">refuses<\/a> to recognize the Amendment).<\/p>\n<p>Still, there&#8217;s a lot of interesting stuff out there about this decision:<\/p>\n<li>Clarence Thomas <a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2010\/06\/29\/AR2010062905329.html\">roars to life<\/a> in his opinion. Thomas is criminally underestimate by his critics.  There have been a number of wonderful opinions he&#8217;s written and he&#8217;s interesting even when I disagree with him.  He&#8217;s no puppet of Scalia.<\/li>\n<li>Chicago hasn&#8217;t <a href=\"http:\/\/www.suntimes.com\/news\/cityhall\/2458402,new-chicago-gun-law-passed-070210.article\">learned its lesson<\/a>. I think SCOTUS understand the needs of cities better than the gun-grabbing Aldermen.<\/li>\n<li>Meanwhile, Jacob Sullum <a href=\"http:\/\/reason.com\/archives\/2010\/06\/30\/gun-shy\">eviscerates<\/a> the liberal wing of the Court. What&#8217;s the point of having a Constitution if the &#8220;will of the people&#8221; is allowed to over-ride it?  Liberties are not liberties if they are subject to a vote.  I doubt the liberal wing would stand by if the &#8220;will of the people&#8221; was to return to segregation.<\/li>\n<li>Glenn Reynolds <a href=\"http:\/\/www.washingtonexaminer.com\/opinion\/columns\/Sunday_Reflections\/SCOTUS-ruling-shows-how-far-gun-rights-have-come-97694104.html#ixzz0snzfmK45\">reflects<\/a> on how much the political landscape has changed.  Two decades ago, strict gun control was supported by all right-thinking people.  Now, it&#8217;s a minority view.
