Atlanta Linkorama

I’m visiting the folks in Atlanta. That means internet access is intermittent. So … while I’m working on some longer posts in the queue … linkorama!

  • Stephen Bainbridge has a good take on the “Worst. President. Ever.” stuff. It’s way to early to judge Bush. And I would certainly rate Buchanan and Johnson lower.

  • This has got to be freaky — a man is trapped in an elevator for 42 hours.
  • One of the problems with the “climate change” crowd is that they assume that whatever the climate was in, say, 1975, it was ideal. I don’t think they’ve invested enough thought into this. If higher CO2 levels mean milder seasons and better harvests, that’s not a bad thing.

    Still, this bit of logic from Indur Goklany is a bit dumb. It is a fact that human prosperity has increased in line with CO2 levels. But it’s also a fact that my weight has tracked my personal income (well, until recently). That doesn’t make being overweight good for me. I just haven’t felt the consequences yet. The question isn’t whether high CO2 levels are hurting us today. It’s all about the long term.

  • I must admit, that the gastric appendectomy story freaked me out when I first heard it. But if it means you can get over appendicitis in a matter of hours, I’m all for it.
  • Do we really need to prosecute people for looking at children? Really? You know, we already have stalking laws on the books.

  • Sometimes I want to give a chance to the Democrats. But then their majority leader says something really stupid. Who knew the Founding Fathers liked earmarks?
  • Ewww. OK, it’s clean and tidy. But yesterday, I put my daughter in a box and pushed her around the room like she was in a racing car. She laughed and giggled the whole time, her eyes alight with glee. Can your zombie babies do that?
  • I was never that big a fan of David Mamet and could give a rat’s ass about his politics. But Gutman is right. Hollywood will now find him cliched and sooo 90’s, now that he’s a libertarian.
  • I’m with Bob Barr, who is so much more likable now that’s he’s not in Congress. Seizing cars because they are driven by illegal immigrants is going to ruin a lot of innocent people. I hate seizure laws; hate them.
  • This story, about a man losing his dead wife’s voice mail in an upgrade, is just heartbreaking. I’ve never had that situation, but once, after a breakup, I kept an ex-girlfriend’s last phone message on my machine for a long time (an “I love you” message, not a “go to hell” message).

  • A 16-year-old has consensual sex with a girl. Finds out she’s 13. Now he’s a registered sex offender and is getting constant harassment. The more I read, the more I hate these registries. Just a reminder: 80-90% of sexual crimes are committed by someone the victim knows, not the stranger living down the street.
  • That icon of the 80’s — Sharper Image — is going bankrupt. You could see this coming when they forced their founder out of the CEO chair. Maverick businesses tend to collapse when the maverick leaves — see Dell Computers.

    Killing Them Softly

    The last of the electric chairs has been banned:

    On Friday, the court said electrocution is unconstitutional, a stunning response to Dean, nine others on death row and those who question whether the electric chair constitutes cruel and unusual punishment.

    “Condemned prisoners must not be tortured to death, regardless of their crimes,” Judge William Connolly wrote in the 6-1 opinion for the court.

    The decision erased Nebraska’s distinction as the only state with electrocution as its sole means of execution. State courts are left with the ability to sentence people to death but no way to carry out the penalty.

    I’m not going to get into my dealth penalty views today. But I’ve been reading up on some of the history, which is quite gruesome. Lethal injection isn’t exactly humane either. The Lancet did a study years ago — still controversial — that many lethal injection subjects were aware and in excruciating pain when they died. Knowing what little I do of thiopental, that sounds right to me.

But, apparently, because he doesn’t want to rip the heads off Democrats and drink from the stump, that makes him a “liberal”.

    Wipe Up Your Own Blood

    Oh, man.

    New Jersey authorities sent a “disgraceful and obscene” notice to two grieving families – a lawsuit against them and their four loved ones killed in a terrible crash for damage the victims allegedly caused to the Turnpike.

    The negligence suit, filed by lawyer William B. Ziff on behalf of the New Jersey Turnpike Authority, demanded money from both the Ryan and Christmas families, who lost relatives – including a toddler – in a horrific August 2006 crash on the Turnpike near Teaneck.

    The crash occurred after a tractor-trailer with bad brakes, carrying bricks and traveling at 70 mph, plowed into stalled traffic, smashing into a car driven by Theresa Christmas, 41.

    Christmas was killed, as was her husband, Charles, 40, and daughter Victoria, 2, sources said. Another daughter, baby Theresa, survived the crash.

    The truck then hit a car driven by Norma Ryan, 37, who also was killed.

    All three dead adults, along with relatives, were named in the Turnpike Authority’s lawsuit seeking money for damage to the road’s infrastructure.

    “This is disgraceful and obscene,” said lawyer Jeffrey Lisabeth, who represents Norma Ryan’s grieving husband, Allan Ryan, of Voorhees, NJ. The husband is suing the truck driver and others over his wife’s death.

    “Mrs. Ryan must have bled on the roadway surface while she was being crushed by tons of bricks, and they want to charge her husband for the cleanup?” Lisabeth said.

    The suit is “the most outrageous thing I have seen in a long time,” said lawyer Sam Davis, who represents orphaned crash survivor little Theresa Christmas, now 2, and her relatives in a separate civil suit against the truck driver and others.

    After The Post called about the lawsuit, Ziff rushed out to Union County Superior Court and canceled it.

    “It should not have happened,” said NJTA spokesman Joe Orlando. “It was a clerical error. We would like to apologize to the family.”

    But the action now prevents any future claims from being brought by the authority against the truck driver, who officials say caused the deadly crash, as well as his firm.

    As a result, money that may have been recovered for taxpayers will not be collected.

    Felony Murder

    The NYT has a nice, if not exactly definitive, article on the felony murder statute. Worth a read. I hate to say this but I am growing rapidly fatigues with victim’s rights groups. They have a point but they often seem far more interested in vengeance than justice.

    I also like that after the mother finds her daughter brutally murdered, the prosecutors give her a three-year prison sentence because the dead daughter had pot in the safe. Nice.

  • When judicial activism is a good thing:

    It’s a powerful argument, and it may well resonate with the conservative justices who think that judges often overreach and “substitute their own policy preferences” for those of the people’s elected legislators. But I wonder if Helmke really believes that judges should respect the will of legislators and not strike down laws. Does he believe that the Warren Court should not have struck down school segregation, which was clearly the will of the people’s elected representatives–and no doubt the people–in Kansas, as well as in South Carolina and Virginia, whose similar cases were combined with Brown? Does he believe that the Supreme Court was wrong to strike down Virginia’s law against interracial marriage in 1967? The Texas law outlawing sodomy in 2003? The Communications Decency Act in 1997? Does he indeed think the John Marshall Court was wrong to invalidate a section of the Judiciary Act of 1789 in Marbury v. Madison? That’s the implication of his ringing words in defense of legislative absolutism.

    He’s Our Baby Too!

    Man, some lawyers are disgusting.

    Once again, the combination of contingency fees and law enforcement spells trouble: an article by Tresa Baldas in the National Law Journal reports that controversy is mounting over the activities of private firms that go after noncustodial parents’ child support obligations in exchange for a percentage share of the bounty (“Suits collecting around child support collectors”, Sept. 17, no free link). “Critics of the industry — many of them lawyers — claim that private collectors of child support are engaging in predatory practices, such as charging excessive contingency fees as high as 50%, and using aggressive collection tactics that run afoul of federal laws.” The private agencies escape the scrutiny of federal debt collection laws and have been operating effectively without regulation, but state lawmakers are now moving to fill the gap, with 13 states having passed laws intended to protect the services’ clients (if not always their adversaries) by capping fees, prohibiting the agencies from collaring state-directed payments, and giving clients more leeway to withdraw from contracts.

    The National Council of State Legislatures details a range of complaints made against some of the collectors:

    * written and oral communications with obligees designed to look or sound like they are from the state child support agency or other government entity,
    * repeated harassment of employers, family members and neighbors of obligors,

    * keeping as payment for services 50% or more of support collected,

    * intercepting current support payments from the state agency to apply to back support they contracted to collect for the obligee,

    * charging a fee for collections made by the state agency,

    * refusing to terminate contracts when requested by the obligee, and

    * requesting income withholding from employers without proper authority.

    Literally taking money out of the mouths of kids. Nice.

    On the way home, I was hearing news reports about Emily Sander, a college student who was just murdered in Kansas. Turns out, she was posing naked (probably just topless) for her own website. The idiot news media called her a “porn star”, which isn’t even close to true. She was one of hundreds of young women who are making money on the side posing naked on their own web sites. I don’t have a problem with this. They’re doing it of their own free will and men get vicarious pleasure out of looking at women who aren’t surgically enhanced bulemics.

    It will be interesting to see what happens to these women. Many of them are — or claim to be — college students. Will their websites cost them future jobs? For some reason, I doubt it. I think our society is getting a lot less puritanical about such things.

    However, the “porn star” slur that has leaked into the media is a preview of what is to come in the immediate aftermath of this tragedy. No matter why Emily Sander was murdered, this will be blamed on her web site. And we will get all kinds of dire warnings and calls for legislation. Because, as I noted, there are a lot of girls out there doing this. And a nation of 300 million certainly has no shortage of monsters.

    I have a friend who, whenever I support the freedom of women to be nude models, porn stars, prostitutes or whatever, asks me if I would want my daughter to do these things. Of course not. But I do want her to live in a country that treats her like an adult and respects her freedom to do what makes her happy — as long as she doesn’t harm anyone else.
